Value Added Tax Code (CIVA) · Portuguese original · AT source

1 - If, owing to a change of activity or by legal requirement, taxable persons come to carry out taxable transactions which confer the right of deduction, they may still deduct the tax relating to fixed assets, as follows:

a) In the case of assets other than immovable property acquired in the year of the change in the tax regime and in the four preceding calendar years, the deductible tax shall be proportional to the number of years remaining to complete the five-year period from the year in which use of the assets began;

b) In the case of immovable property acquired or completed in the year of the change in the tax regime and in the 19 preceding calendar years, the deductible tax shall be proportional to the number of years remaining to complete the 20-year period from the year of occupation of the property;

c) The deduction may be made in the tax period in which the change occurs.

2 - The deduction provided for in the previous paragraph shall not apply to fixed assets covered by Article 24(7).

3 - The previous paragraphs shall equally apply to taxable persons who, using the actual-allocation method, allocate an asset from the exempt sector to a taxed sector, the deduction being permitted in the period in which that allocation occurs.

4 - The adjustment provided for in paragraph 1(b) shall also apply where, following an exempt letting covered by Article 24(6)(c), the property is used by the taxable person exclusively for transactions which confer the right of deduction.

5 - The deduction referred to in this Article shall not apply to taxable persons who, at the date of the change, were under the special exemption scheme of Article 53.
