Value Added Tax Code (CIVA) · Portuguese original · AT source
1 - In general, 'supply of goods' means the transfer for consideration of tangible goods in a manner corresponding to the exercise of the right of ownership.
2 - For that purpose, electricity, gas, heat, cooling and the like shall be treated as tangible goods.
3 - The following shall also be treated as supplies of goods within the meaning of paragraph 1 of this Article:
a) The physical handing over of goods pursuant to a hire contract containing a clause, binding on both parties, providing for the transfer of ownership;
b) The physical handing over of movable goods pursuant to a contract of sale providing for retention of title until payment of all or part of the price;
c) Transfers of goods between principal and commission agent carried out pursuant to a commission contract as defined in the Commercial Code, including transfers between consignor and consignee of goods sent on consignment. In a commission to sell, the commission agent shall be regarded as the purchaser; in a commission to buy, the principal shall be regarded as the purchaser;
d) The failure to return goods sent on consignment within one year from the date of delivery to the consignee;
e) The handing over of movable goods produced or assembled to order, where all the materials are provided by the taxable person who produced or assembled them;
f) Without prejudice to Article 26, the permanent application of business goods to the private use of the owner of the business or of the staff, or, in general, to purposes other than those of the business, as well as their transfer free of charge, where the tax on those goods or on their component parts has been wholly or partly deductible;
g) The application of goods by a taxable person to an exempt sector of activity, as well as the application to the use of the business of the goods referred to in Article 21(1), where the tax on those goods or on their component parts has been wholly or partly deductible.
4 - The transfer, for consideration or free of charge, of a business establishment or of all or part of a set of assets capable of constituting an independent branch of activity shall not be regarded as a supply where, in any of these cases, the transferee is or, by virtue of the acquisition, becomes a taxable person among those referred to in Article 2(1)(a).
5 - For the purposes of the previous paragraph, the tax administration shall adopt the appropriate regulatory measures, in particular the limitation of the right of deduction, where the transferee is not a taxable person carrying out exclusively taxed transactions.
6 - Nor shall the duly documented transfers made by agricultural cooperatives to their members of goods not packaged for commercial purposes, resulting from the first processing of raw materials delivered by those members, be regarded as supplies, insofar as they do not exceed their household consumption needs, within limits and under conditions to be laid down by Ministerial Order (Portaria) of the Minister of Finance.
7 - Excluded from the arrangements laid down in paragraph 3(f), on the terms defined by Ministerial Order (Portaria) of the Minister of Finance, are goods not intended for subsequent sale which, by reason of their characteristics or of a size or format different from that of the product constituting the unit of sale, are intended, in the form of samples, to present or promote goods produced or marketed by the taxable person itself, as well as gifts of a unit value equal to or less than EUR 50 whose total annual value does not exceed five per thousand of the taxable person's turnover in the previous calendar year, in accordance with commercial practice.
8 - In the case of commencement of activity, the per-thousand ratio referred to in the previous paragraph shall apply to the expected amounts, without prejudice to a correction to be made in the last periodic VAT return to be submitted in the year of commencement of activity, if the final amounts are lower than the expected amounts.
9 - Where a taxable person facilitates, through the use of an electronic interface, distance sales of goods imported in consignments of an intrinsic value not exceeding EUR 150, that taxable person shall be deemed to have received and supplied those goods himself. (Added by Law no. 47/2020 of 24 August)
10 - Where a taxable person facilitates, through the use of an electronic interface, supplies of goods within the European Union by a taxable person not established in the European Union to a non-taxable person, the taxable person who facilitates the supply shall be deemed to have received and supplied those goods himself. (Added by Law no. 47/2020 of 24 August)
11 - Where a taxable person has received and supplied goods under paragraphs 9 and 10, the dispatch or transport of the goods shall be ascribed to the supply of goods made by that taxable person. (Added by Law no. 47/2020 of 24 August)
Note: The amendments introduced by Law no. 47/2020 of 24 August enter into force, in accordance with Article 10 thereof, on 1 January 2021.

Na comissão de venda considera-se comprador o comissário; na comissão de compra é considerado comprador o comitente;
d) A não devolução, no prazo de um ano a contar da data da entrega ao destinatário, das mercadorias enviadas à consignação;
e) A entrega de bens móveis produzidos ou montados sob encomenda, quando a totalidade dos materiais seja fornecida pelo sujeito passivo que os produziu ou montou;
f) Ressalvado o disposto no artigo 26.º, a afectação permanente de bens da empresa, a uso próprio do seu titular, do pessoal, ou em geral a fins alheios à mesma, bem como a sua transmissão gratuita, quando, relativamente a esses bens ou aos elementos que os constituem, tenha havido dedução total ou parcial do imposto;
