Value Added Tax Code (CIVA) · Portuguese original · AT source
1 - Where the acquirer is required to correct the deduction as provided for in paragraph 5 of the previous Article, the correction shall be made in the periodic VAT return relating to the tax period in which the notification took place, identifying, in an annex, the corresponding invoices, including the identification of the issuer, the invoice amount and the tax charged therein.
2 - Whenever the acquirer does not correct the deduction as provided for in the previous paragraph or does not proceed as referred to in paragraph 6 of the previous Article, the Tax and Customs Authority shall issue an additional assessment, under Article 87, corresponding to the tax not corrected by the debtor, simultaneously notifying the taxable person that the request referred to in paragraph 1 of the previous Article has been granted, without prejudice to paragraph 4 of that Article.
3 - In the event of total or partial recovery of the debts, taxable persons that have previously deducted the tax associated with doubtful or irrecoverable debts shall pay the tax corresponding to the amount recovered with the periodic VAT return to be submitted for the period of receipt, without observing the deadline laid down in Article 94(1); deduction of the tax by the acquirer shall then depend on the submission of a request for prior authorisation, the previous Article applying with the necessary adaptations.
