Article 23Methods of deduction relating to goods for mixed use

Value Added Tax Code (CIVA) · Portuguese original · AT source

1 - Where a taxable person, in the course of their activity, carries out transactions which confer the right of deduction and transactions which do not confer that right, under Article 20, the deduction of the tax incurred on the acquisition of goods and services used in carrying out both types of transaction shall be determined as follows:

a) In the case of goods or services partly allocated to transactions not arising from the exercise of an economic activity referred to in Article 2(1)(a), the non-deductible tax resulting from that partial allocation shall be determined in accordance with paragraph 2;

b) Without prejudice to the previous subparagraph, in the case of goods or services allocated to transactions arising from the exercise of an economic activity referred to in Article 2(1)(a), some of which do not confer the right of deduction, the tax shall be deductible in the percentage corresponding to the annual amount of the transactions giving rise to deduction.

2 - Notwithstanding subparagraph (b) of the previous paragraph, the taxable person may make the deduction according to the actual allocation of all or part of the goods and services used, on the basis of objective criteria that make it possible to determine the extent to which those goods and services are used in transactions which confer the right of deduction and in transactions which do not confer that right, without prejudice to the Directorate-General for Taxes imposing special conditions on the taxable person or terminating that procedure where it is found that they cause or may cause significant distortions in taxation.

3 - The tax administration may require the taxable person to proceed in accordance with the previous paragraph:

a) Where the taxable person carries on distinct economic activities;

b) Where application of the procedure referred to in paragraph 1 leads to significant distortions in taxation.

4 - The deduction percentage referred to in paragraph 1(b) shall result from a fraction having, as numerator, the annual amount, exclusive of tax, of the transactions giving rise to deduction under Article 20(1) and, as denominator, the annual amount, exclusive of tax, of all transactions carried out by the taxable person arising from the exercise of an economic activity referred to in Article 2(1)(a), as well as non-taxed subsidies other than equipment subsidies.

5 - The calculation referred to in the previous paragraph shall not, however, include supplies of fixed assets which have been used in the business's activity, nor real estate or financial transactions which are ancillary to the activity carried on by the taxable person.

6 - The deduction percentage referred to in paragraph 1(b), calculated provisionally on the basis of the amount of transactions carried out in the previous year, as well as the deduction made under paragraph 2, calculated provisionally on the basis of the objective criteria initially used for applying the actual-allocation method, shall be corrected in accordance with the final figures for the year to which they relate, giving rise to the corresponding adjustment of the deductions made, which must be included in the return for the last period of the year to which it relates.

7 - Taxable persons who commence their activity or substantially change it may deduct tax on the basis of an estimated provisional percentage, to be entered in the returns referred to in Articles 31 and 32.

8 - In determining the deduction percentage, the quotient of the fraction shall be rounded up to the next whole hundredth.

9 - For the purposes of this Article, the Minister of Finance may, in respect of certain activities, treat as non-existent the transactions giving rise to deduction or those that do not confer that right, whenever they constitute an insignificant part of total turnover and the procedure provided for in paragraphs 2 and 3 is not shown to be feasible.

a) Tratando-se de um bem ou serviço parcialmente afecto à realização de operações não decorrentes do exercício de uma actividade económica prevista na alínea a) do n.º 1 do artigo 2.º, o imposto não dedutível em resultado dessa afectação parcial é determinado nos termos do n.º 2;

a) Quando o sujeito passivo exerça actividades económicas distintas;
