Article 22Time and manner of exercising the right of deduction

Value Added Tax Code (CIVA) · Portuguese original · AT source

1 - The right of deduction shall arise at the time the deductible tax becomes chargeable, in accordance with Articles 7 and 8, and shall be exercised by subtracting from the total amount of tax due on the taxable person's taxable transactions during a return period the amount of deductible tax chargeable during that same period.

2 - Without prejudice to Article 78, the deduction must be made in the return for the period in which the invoices or the VAT payment receipt forming part of the import declarations were received, or for a subsequent period. (Wording introduced by Decree-Law no. 197/2012 of 24/08)

3 - If the documents referred to in the previous paragraph are received in a return period other than that in which they were issued, the deduction may be made, if still possible, in the return period in which they were issued.

4 - Whenever the deductible tax exceeds the amount due on taxable transactions in the corresponding period, the excess shall be deducted in the following tax periods.

5 - If, after 12 months from the period in which the excess first arose, a credit in favour of the taxable person exceeding EUR 250 persists, the taxable person may request its refund.

6 - Notwithstanding the previous paragraph, the taxable person may request a refund before the end of the 12-month period where it ceases its activity or comes to fall within Article 29(3) and (4), Article 54(1) or Article 61(1), provided that the amount of the refund is equal to or greater than EUR 25, as well as where the credit in its favour exceeds EUR 3,000. (Wording introduced by Law no. 10/2009 of 10/03)

7 - In any case, where the amount to be refunded exceeds EUR 30,000, the Tax and Customs Authority (AT) may require a security, bank guarantee or other appropriate guarantee, which shall suspend the period for counting the compensatory interest referred to in the following paragraph until it is provided, and which must be maintained for a period of six months. (Wording introduced by Decree-Law no. 197/2012 of 24/08)

8 - Tax refunds, where due, must be made by the Tax and Customs Authority by the end of the second month following that in which the request was submitted or, in the case of taxable persons registered in the monthly refund scheme, within 30 days after the submission of that request, after which taxable persons may request payment of compensatory interest under Article 43 of the General Tax Law. (Wording introduced by Decree-Law no. 197/2012 of 24/08)

9 - The Minister of Finance may authorise the Tax and Customs Authority to make refunds under conditions different from those laid down in the previous paragraphs in respect of sectors of activity whose turnover consists essentially of transactions provided for in Article 20(1)(b) or in respect of which the obligation to charge the tax lies with the acquirer. (Wording introduced by Decree-Law no. 197/2012 of 24/08)

10 - The Minister of Finance may, by Order, in accordance with the criteria laid down in Article 85, require taxable persons to submit, together with the refund request, documents or information relating to the transactions giving rise to that request, failing which the refund shall not be deemed due for the purposes of paragraph 8.

11 - Refund requests shall be rejected where the taxable person does not provide information enabling the legitimacy of the refund to be assessed, and where the deductible tax relates to a taxable person with a non-existent or invalid tax identification number or which has suspended or ceased its activity in the period to which the refund relates.

12 - Failure to provide the guarantee, when requested, shall suspend the period laid down in Article 45(1) of the General Tax Law.

13 - The decision referred to in paragraph 11 may be challenged by hierarchical appeal, administrative complaint or judicial challenge, as provided for in Article 93.
14 - Registration in the monthly refund scheme referred to in paragraph 8 shall be made at the request of the taxable person, by electronic data transmission via the website of the Tax and Customs Authority, by the end of November of the year preceding that in which it is to take effect, the terms and conditions of access to be defined by Regulatory Order (despacho normativo) of the Minister of Finance. (Wording introduced by Decree-Law no. 197/2012 of 24/08)

15 - Taxable persons registered in the monthly refund register shall be covered by the monthly periodicity scheme as provided for in Article 41, and shall be required to remain in that register for one year. (Wording introduced by Law no. 2/2010 of 15/03)

16 - Failure to comply with any of the requirements laid down in the Regulatory Order of the Minister of Finance, or a finding that the information provided for the purposes of registration is inaccurate or false, shall constitute grounds for non-acceptance of the registration or for exclusion from the register if the taxable person does not remedy the non-compliance within eight days of being notified by the tax administration to do so. (Wording introduced by Law no. 2/2010 of 15/03)

17 - Exclusion from the register shall take effect from the first day of the tax period in which it occurs and shall render registration inadmissible for the following three years. (Wording introduced by Law no. 2/2010 of 15/03)

Artigo 22.º — Momento e modalidades do exercício do direito à dedução
