1 - Articles 36 et seq. shall be complied with whenever, after the invoice has been issued, the taxable amount of a transaction or the corresponding tax is corrected for any reason. (Wording introduced by Decree-Law no. 197/2012 of 24 August, in force from 1 January 2013)
2 - If, after the registration referred to in Article 45 has been made, the transaction is cancelled or its taxable amount reduced as a result of invalidity, termination, rescission or reduction of the contract, the return of goods or the granting of rebates or discounts, the supplier of the goods or services may deduct the corresponding tax by the end of the tax period following that in which the circumstances giving rise to the cancellation of the tax charged or the reduction of its taxable amount occurred.
3 - In the case of incorrect invoices that have already been registered as referred to in Article 45, correction is mandatory where too little tax has been charged, and may be made without any penalty by the end of the period following that to which the invoice to be corrected relates; it is optional where too much tax has been charged, but may only be made within a period of two years.
4 - The acquirer of the goods or recipient of the service who is a taxable person, if it has already registered a transaction in respect of which its supplier has carried out a cancellation, reduction of its taxable amount or downward correction of the amount invoiced, shall correct the deduction made by the end of the tax period following that of receipt of the correcting document.
5 - Where the taxable amount of a transaction or the corresponding tax is corrected downwards, the adjustment in favour of the taxable person may only be made where it holds proof that the acquirer has taken note of the correction or has been reimbursed the tax; otherwise the corresponding deduction shall be considered improper.
6 - The correction of clerical or calculation errors in the records referred to in Articles 44 to 51 and 65, in the returns mentioned in Article 41 and in the payment slips or returns mentioned in Article 67(1)(b) and (c) is optional where it results in tax in favour of the taxable person, but may only be made within a period of two years, which, in the case of exercise of the right of deduction, shall be counted from the date on which that right arises under Article 22(1); it is mandatory where it results in tax in favour of the State.
7 - Taxable persons may also deduct the tax relating to debts considered irrecoverable:(Wording introduced by Law no. 3-B/2010 of 28 April)
a) In enforcement proceedings, after the registration referred to in Article 717(2)(b) of the Code of Civil Procedure; (Wording introduced by Law no. 82-B/2014 of 31 December)
b) In insolvency proceedings, where the insolvency is declared to be of a limited nature, after the judgment verifying and ranking the claims provided for in the Insolvency and Corporate Recovery Code has become final or, where applicable, after court approval of the plan that is the subject of the resolution provided for in Article 156 of that Code; (Wording introduced by Law no. 82-B/2014 of 31 December)
c) In special revitalisation proceedings, after court approval of the recovery plan provided for in Article 17-F of the Insolvency and Corporate Recovery Code; (Wording introduced by Law no. 66-B/2012 of 31 December)
d) Under the terms of the Out-of-Court Corporate Recovery System (SIREVE), after conclusion of the agreement provided for in Article 12 of Decree-Law no. 178/2012 of 3 August. (Added by Law no. 66-B/2012 of 31 December)

b) The debts exceed EUR 750 and are below EUR 8,000, VAT included, where the debtor, being a private individual or a taxable person carrying out exclusively exempt transactions that do not confer the right of deduction, is listed in the computerised register of enforcement proceedings as a judgment debtor against whom earlier enforcement proceedings were brought which have since been suspended or terminated because no attachable assets were found; (Wording introduced by Law no. 64-A/2008 of 31 December)
c) The debts exceed EUR 750 and are below EUR 8,000, VAT included, an enforcement order has been affixed in order-for-payment proceedings (injunção) or the debt has been recognised in an action for judgment, and the debtor is a private individual or a taxable person carrying out exclusively exempt transactions that do not confer a right of deduction;
d) The debts are below EUR 6,000, VAT included, the debtor is a taxable person with a right of deduction, the debts have been recognised in an action for judgment or claimed in enforcement proceedings, and the debtor has been served by public notice.
e) The debts exceed EUR 750 and are below EUR 8,000, VAT included, where the debtor, being a private individual or a taxable person carrying out exclusively exempt transactions that do not confer a right of deduction, appears, at the time of the deduction, on the publicly accessible list of enforcement proceedings terminated with partial payment or because no attachable assets were found. 9 - The overall amount of the debts referred to in the previous paragraph, the overall amount of the tax to be deducted, the steps taken by the creditor to collect the debts and the total or partial failure of such steps shall be supported by documentary evidence and certified by a statutory auditor, who shall also certify that the legal requirements for deduction of the tax relating to debts considered irrecoverable under paragraph 7 of this Article are met. (Wording introduced by Law no. 66-B/2012 of 31 December) (Added by Law no. 64-A/2008 of 31 December)
10 - The certification by a statutory auditor referred to in the previous paragraph shall be made for each of the periods in which the adjustment was made and by the end of the deadline set for submission of the periodic VAT return or by the date of its submission, where this takes place after the deadline.
11 - In the case provided for in paragraph 7 and in paragraph 8(d), the acquirer of the goods or services, where it is a taxable person, shall be notified of the total or partial cancellation of the tax, for the purposes of correcting the deduction initially made; that notification shall identify the invoices, the amount of the debt and of the tax to be adjusted, the proceedings or agreement concerned, and the period in which the adjustment is made. (Wording introduced by Law no. 82-B/2014 of 31 December)
12 - Where the debts are recovered, in whole or in part, taxable persons shall pay the tax in the period in which it is received, without observing, in this case, the deadline laid down in Article 94(1).
13 - Where the taxable amount is reduced, that amount shall be split between consideration and tax when the corresponding document is issued, if correction of the tax is also sought.
14 - Where the obligation to charge and pay the tax lies with the acquirer of the goods and services and the corresponding amounts have not been included in the periodic VAT return, giving rise to the corresponding charging and deduction, or have been included after the legally established deadline, the charging and deduction shall be accepted without any consequences provided that the taxable person submits the replacement return, without prejudice to any applicable penalty.
15 - The previous paragraph shall also apply to taxable persons entitled to partial deduction of the tax under Article 23, without prejudice to the additional assessment and payment of the tax and of the compensatory interest due on the difference.
